1. Acceptance of Terms

By accessing or using MasalaBear ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after any changes constitutes acceptance of the new terms.

2. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

3. User Content and License Grant

Ownership: You retain ownership of all content you submit to MasalaBear, including recipes, photographs, comments, and other materials ("User Content").

License Grant: By submitting User Content to MasalaBear, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in any media formats and through any media channels, whether now known or hereafter developed.

Sublicense Rights: This license includes the right to sublicense User Content to third parties for promotional, marketing, or other business purposes related to the Service.

Your Representations: By submitting User Content, you represent and warrant that:

  • You own or have the necessary rights to submit the User Content
  • You have the right to grant the license described above
  • The User Content does not infringe upon the intellectual property rights of any third party
  • You have obtained necessary permissions from any individuals depicted in photographs

No Compensation: You understand and agree that you will not receive any compensation for User Content you submit to the Service.

4. Content Guidelines

You agree not to submit User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes any patent, trademark, copyright, or other proprietary rights
  • Contains software viruses or any other malicious code
  • Is spam, advertising, or promotional material not authorized by us
  • Impersonates any person or entity
  • Contains false or misleading information

5. Content Removal

We reserve the right, but have no obligation, to review, monitor, edit, or remove any User Content at our sole discretion, for any reason or no reason, including User Content that we determine violates these Terms of Service or may be offensive, illegal, or that might violate the rights of, harm, or threaten the safety of others.

6. Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Requests by law enforcement or government agencies
  • Extended periods of inactivity
  • Unexpected technical or security issues
  • Engagement in fraudulent or illegal activities

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MASALABEAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Recipe information is provided for informational purposes only. We are not responsible for any adverse effects resulting from the use of recipes on the Service. Users with allergies or dietary restrictions should exercise caution.

9. Indemnification

You agree to indemnify, defend, and hold harmless MasalaBear and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms of Service.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Service shall be brought exclusively in the courts located in Maryland, and you consent to the personal jurisdiction and venue of such courts.

11. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
